Simplifying Estate Planning with a Revocable Trust

Your Trusted Advisors in Nashville, TN

At Elder Law of Nashville, we guide you through the estate planning process by creating a revocable trust that meets your unique needs. A revocable trust offers flexibility, allowing you to manage and protect your assets during your lifetime and ensure a smooth transition for your beneficiaries. Our experienced attorneys will help you establish the trust, transfer assets, and make adjustments as needed, providing peace of mind and ensuring your wishes are honored both now and in the future.

What is a Revocable Trust?

A revocable trust, often called a “living trust,” is a powerful estate planning tool that allows you to maintain control over your assets while providing flexibility and privacy. Unlike a will, a revocable trust does not go through the probate process, which means your estate can be settled more quickly and privately. This type of trust is particularly beneficial for residents of Nashville, Franklin, Brentwood, and across Tennessee who wish to manage their estate efficiently during their lifetime and ensure a smooth transition for their beneficiaries.

What is a Revocable Trust? | Elder Law Of Nashville

Purpose and Benefits of Setting Up a Revocable Trust in Tennessee

Creating a revocable trust offers several key advantages for individuals and families in Nashville, Brentwood, Franklin, and the surrounding areas:

Avoiding Probate:

In Tennessee, the probate process can be lengthy and costly. By placing your assets in a revocable trust, you can avoid probate, saving your loved ones time, money, and stress.

Flexibility:

You have the ability to amend or revoke the trust at any time during your lifetime. This means you can adjust the trust to reflect changes in your life circumstances, such as marriage, divorce, or the birth of a child.

Privacy:

A revocable trust keeps your estate plan private. Unlike a will, which becomes a public record during probate, the terms of your trust remain confidential, protecting your privacy and that of your beneficiaries.

Incapacity Planning:

A revocable trust allows for seamless management of your assets if you become incapacitated. By appointing a trusted individual as a successor trustee, you ensure that your financial affairs will be managed according to your wishes without court intervention.

Key Features of a Revocable Trust in Tennessee

 1. Control and Flexibility: As the grantor, you maintain full control over the trust assets during your lifetime. You can manage, amend, or revoke the trust as needed, allowing you to adapt to changes in your financial situation or family dynamics without court intervention.

    2. Efficient Asset Management: In the event of incapacity, a successor trustee can immediately step in to manage the trust assets, avoiding needing a court-appointed guardian. This ensures a smooth transition and continued financial stability, which is particularly valuable in times of uncertainty.

    3. Tailored Distribution: A revocable trust allows you to specify how and when your assets are distributed, which is ideal for those with minor children, special needs beneficiaries, or concerns about asset protection. This flexibility ensures that your estate plan aligns with your specific wishes and provides for your loved ones in the best possible way.

My Mother choose Elder Law to set up the Family Trust after following Barbara's informative articles in the paper for several years. Once we meet with Barbara and her team, Mom was very sure that was the route we were taking. Mom was still conducting their affairs and it was established fairly quickly and easily. It was easy to administer and as life comes at you rather fast and hard sometimes, within two years we lost both Dad and Mom. There were some intrapersonal family obstacles that we encountered as we were closing but Barbara and her staff, especially my lawyer Adam, stood by me and guided me every step of the way to a peaceful resolution. I understand why Mom chose Elder Law and I would recommend to anyone looking for a family trust situation.

The whole team at Elder Law at Nashville are experts at what they do. They helped me pull together all the documentation to apply for Medicare, including managing through estate spend-down requirements and the healthcare assessment, to full success for my aging mother. They are courteous and highly responsive. I recommend them to anyone in need of their services.

Estate planning can be quite difficult and I truly appreciate Barbara Moss and the Elder Law team for everything she did to help my mother and father ensure their wishes were enacted after their passing. She was very caring and helpful and always answered our questions. The documents she prepared for my mother and father could not have captured their relationship and their wishes better. If you truly want professional advice tailored for your family's needs, this is a great place to go. Thank you Elder Law of Nashville for serving my parents and our family!
